Terms & Conditions
§ 1 Scope
These Terms and Conditions apply to all inquiries, offers, orders and contracts between Pampas Essence (Dennis Menner, hereinafter "Provider") and customers (hereinafter "Customer").
§ 2 Contracting Party
The contracting party is Dennis Menner, trading under the name Pampas Essence, Hausener Str. 13, 73337 Bad Überkingen, Germany. Pampas Essence is a small sole-trader business (Kleingewerbe / Nebengewerbe).
§ 3 Product Presentation and Contract Formation
The display of products on this website does not constitute a binding offer but an invitation to make an inquiry (invitatio ad offerendum). A binding contract is only formed upon a written order confirmation from the Provider, in which price, scope and delivery conditions are individually agreed.
For individually crafted pieces (Custom Interior Pieces), a personal consultation on size, finish and timing takes place before the order is confirmed.
§ 4 Prices
All stated prices are final prices. Pursuant to § 19 UStG (small business regulation), no VAT is charged or shown. Any applicable delivery costs are stated separately in the individual offer prior to contract formation.
§ 5 Payment
Payment terms are agreed individually in the offer. The Provider reserves the right to require a deposit for custom commissions.
§ 6 Delivery
Delivery is arranged individually — typically as a personal handover within the agreed delivery area. Delivery area, delivery costs and delivery period are communicated in the offer prior to contract formation. Standard delivery time for standard products: approx. 7–21 business days by arrangement, unless otherwise stated. Delivery times for custom pieces may vary.
§ 7 Natural Product Characteristics
All pampas arrangements consist of natural materials. Colour variations, differences in volume and form, and slight shedding of the pampas plumes are natural characteristics and do not constitute a defect. Product photos show possible finishes and are not binding for each individual piece.
§ 8 Warranty
The statutory warranty rights pursuant to §§ 434 ff. BGB apply. The warranty does not cover natural changes to the plant material resulting from improper storage, moisture or heat.
§ 9 Custom Commissions
For arrangements made to individual customer specifications (Custom Interior Pieces), the statutory right of withdrawal may be excluded to the extent permitted by law (§ 312g para. 2 no. 1 BGB). The Provider will inform the Customer prior to order placement if this exclusion applies.
§ 10 Limitation of Liability
The Provider is fully liable for damages arising from injury to life, body or health, and for intentional or grossly negligent breaches of duty. In all other respects, liability for slight negligence is limited to foreseeable, typically occurring damages.
§ 11 Applicable Law and Jurisdiction
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, the statutory places of jurisdiction apply.
